In the instant contempt petition, the petitioners have complained non- compliance of order dated 16.08.2018, passed in SWP 1922/2018 wherein, upon disposal of the petition, respondents came to be directed to accord consideration to the case of the petitioners in the light of the averments made in the petition and judgment dated 26.02.2008 passed in SWP 2455/2001 read with judgment dated 27.07.2009 passed in CDLSW No. 56/2008 c/w LPA(SW) 142/2008, provided that their case is covered by the said judgment. Respondents have filed multiple compliance reports including the one dated 10.08.2023, accompanied with a consideration order No. 147/2023 dated 15.06.2023, wherein, it is being inter alia stated that upon examination of the cases on the touchstone of the rules and having regard to the hon’ble High Court orders on the subject, the claims of the petitioners have been found not covered under rules and bereft of any merit and accordingly, rejected. Perusal of the record available on the file in general and the statement of
facts filed by the respondents including consideration order dated 15.06.2023, manifestly tends to show that the respondents-contemnors have carried out the directions passed by this Court, thus, necessitating the recalling of the contempt notice and closure of the contempt proceedings. Ordered accordingly.
