The petitioner by means of the present writ petition has prayed for the following relief:- "i. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to not use the petitioner's plot no.336/Chak No.1539 for the installation of the drinking water pump under the scheme of Water Sanitation Mission on spot on the petitioner's plot no.336/1/Chak No.1539 situated in Village Baisar, Post Office Baisar via Dhani Bazaar, Tehsil Pharenda, District-Maharajganj. ii. Issue a writ, order or direction in the nature of mandamus commanding and directing to respondents to consider and decide the petitioner's grievance pending before the authority concerned forthwith and restrain the respondents from using the petitioner's land. iii. And/Or may pass any other and further order, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. iv. Award the cost of the petition in favour of the petitioner." 3. Sri Rajesh Kumar Pal, learned Standing Counsel on instruction, which is taken on record, states that as of today, the installation of tube-well has been stopped. The relevant extract of the instruction is reproduced herein below:- "कायार्लय अिधशाषी अिभयंता के पत्र संख्या 1238/V 36 िदनांक 23.06.2025 द्वारा अवगत कराया गया है िक "िक भारत सरकार के महत्वपूणर् कायर्क्रम जल जीवन िमशन के अन्तगर्त जनपद महराजगंज के समस्त Versus Counsel for Petitioner(s) : Arvind Kumar Srivastava, Bhaju Ram Pprasad Sharma Counsel for Respondent(s) : C.S.C., Sudhir Bharti Srinivas .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) ग्रामों में शुद्ध पेयजल आपूित हेतु पेयजल योजना के अंतगर्त पानी िक टंकी का िनमार्ण कराया जाना प्रस्तािवत है। उक्त प्रस्तािवत कायर् के अन्तगर्त जनपद महराजगंज के िवकास खण्ड धानी के ग्राम वैसार में उच्च जलाशय िनमार्ण हेतु पूवर् में चक संख्या-342 रकवा-0.73 हेक्टेयर एवं चक संख्या-343 रकवा-0.081 हेक्टेयर उपलब्ध करायी गयी थी। परन्तु उक्त ग्राम में चकबंदी का कायर् होने के कारण िदनांक 17.05.2025 को ग्राम प्रधान, चकबंदी लेखपाल (श्री िदनेश कु मार यादव), चकबंदी कानूनगो (श्री शैमकरन) की संयुक्त टीम द्वारा सीमांकन कर पुनः प्लाट संख्या-336/चक संख्या-1539 भूिम िचिन्हत की गयी िजस पर वाटर सोसर् प्राप्त करने हेतु बोिरग कायर् प्रारम्भ िकया गया था, िजसे वतर्मान में बंद करा िदया गया है। (संलग्नक 3)।" 4. Since, it has come in the instruction that installation of tube-well has been stopped, therefore, no further order is required to be passed in the present writ petition. 5.
