PUBLIC PROSECUTOR The Court made the following ORDER: Today, when the matter came up for hearing, none appears for the petitioner nor is there any representation made on his behalf. Hence, this Court is proceeding to dispose of the matter based on the material available on record. 2 2. This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking anticipatory bail, in connection with Crime No.128 of 2024 of Salur Rural Police Station, Parvathipuram Manyam district. 3. A case has been registered against the petitioner herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 4. Case of the prosecution, in brief, is that, on 24.09.2024, at about 08.30 hours, on receipt of credible information, the Sub- Inspector of Police, Salur Rural Police Station, along with his staff and mediators, while conducting vehicle checking at NH-26 road, outskirts of Jeegiram village of Salur Mandal, found two persons coming on a motor cycle and scooty from P. Konavalasa to Salur side. On seeing the police, they tried to escape from the spot. The police caught hold of one person, the rider of Scooty bearing registration No.OD 10X 3978, and found that he was in possession and illegal transportation of 25 Kgs of Cannabis (Ganja) to Visakhapatnam. The other person, who is 3 rider of Unicorn motor cycle bearing registration No.OD 10X 0027, escaped from the spot by leaving the motor cycle there. The contraband along with vehicles and other material was seized under cover of a mediators report and a case has been registered against the accused. 5. Heard learned Assistant Public Prosecutor appearing on behalf of the respondent/State and perused the record. 6. The quantity of contraband allegedly seized from the possession of the accused is 25 Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor submits that the investigation is at nascent stage . In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner herein. 7. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. _______________________ K.
