Mr. Aritra Shankar Ray, learned advocate led by Mr. Rabindranath Mahato, learned advocate appears for the petitioner. Mr. Nilay Baran Mandal, learned advocate led by Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader appears for the alleged contemnor. Learned advocate appearing for the alleged contemnor submits a compliance report in the form of affidavit today in Court, the same is taken on record. Copy has already been served. Today 2 the scope of contempt remains to a limited extent for granting penal interest at the rate of 9% per annum which has not been paid. Mr. Nilay Baran Mandal, learned advocate, on instruction from his client submits that the alleged contemnor has already issued P.P.O. and interest will have to be calculated, released and paid by the jurisdictional Treasury Officer. He further submits that the alleged contemnor has already forwarded the file before the jurisdictional Treasury Officer for calculation of interest and to take steps for payment. In view of the above, the petitioner shall implead the jurisdictional Treasury Officer as an alleged contemnor in this contempt proceeding. The impleadment shall be carried out in the cause- title of the original contempt application by putting the signature of the learned advocate on record for the petitioner. The amended contempt application shall be served upon the impleaded alleged contemnor and the petitioner shall file an affidavit- of-service on the next day. It is made clear, that during pendency of this contempt application the alleged present contemnor and the alleged contemnor to be impleaded shall not be precluded to carry out and 3 comply with the direction of this Court dated May 21, 2025 read with May 21, 2025 and file a compliance report on the next day. In the event of default, the Court may proceed on the next day to issue rule upon the alleged contemnors. The matter shall appear under the heading hearing ‘Contempt Application’ on July 3, 2026.
