02/27.02.2025 Heard the Parties.
Petitioner has been made an accused in connection with S.T. Case No. 206 of 2024, arising out of Tundi P.S. Case No. 59 of 2023, Corresponding to G. R. Case No. 790/2024, for the offences registered under sections 398/34 of the Indian Penal Code and section 25(1-B) a/ 35 of Arms Act, pending in the court of learned Additional Sessions Judge-XI, Dhanbad.
On 08.08.2023, five unknown persons waylaid the Informant near Water Tank at Thepatand Tundi and attempted to snatch money from him. The Informant raised alarm, on which, people of the locality gathered there and apprehended two persons namely Akbul Ansari and Makbool Ansari.
The apprehended co-accused persons spelt out the name of the petitioner that he was also involved in the occurrence but managed to escape.
Learned lawyer for the petitioner submitted that petitioner has not been put on T.I. parade. It was further submitted that apart from the confession there is no other material against the petitioner on the record.
It was further submitted that similarly situated co- accused have been granted bail by this court earlier.
Learned A.P.P. has opposed the prayer for bail and
submitted that the bail application of the co-accused persons have been earlier rejected by this court.
Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Dhanbad in connection with S.T. Case No. 206 of 2024, arising out of Tundi P.S. Case No. 59 of 2023, Corresponding to G. R. Case No. 790/2024.
