Heard the parties. The petitioner has filed this application for quashing of process issued under Section 82 Cr.P.C. in connection with Barkagaon P.S. Case No.37 of 2023 registered under Section 376 of the I.P.C. and section 4 of the POCSO Act. From the perusal of the ordersheet annexed with this application, it appears from order dated 06.02.2025 that the investigating officer has submitted an execution report of non-bailable warrant of arrest issued against this petitioner stating therein that the petitioner was avoiding his arrest.
Learned counsel for the petitioner submitted that petitioner has preferred Anticipatory Bail Application before this Court. However, his Anticipatory Bail Application was not taken up. Mrs. Kumari Rashmi, learned A.P.P. submitted that no interim order has been passed in the Anticipatory Bail Application filed by the petitioner. The learned court below has issued process under Section 82 Cr. P.C. after the receipt of execution report of the non-bailable warrant of arrest issued against the petitioner. I do not find any illegality in the order passed by the learned court below, accordingly, this Cr.M.P. is dismissed. Pending, I.A. if any, stands disposed of.
