Hon'ble Jayant Banerji,J. 1. This writ petition has been filed with a prayer to direct an inquiry to be conducted in the matter relating to award of contract by the respondent-Mandi Parishad. 2. It is alleged that in a clandestine manner, the contract of work has been awarded to some other firm. Petitioner asserts that such contract was earlier awarded to the petitioner-firm. 3. Learned counsel for the respondents, Ms. Saumya Mandhyan, states that the contract was duly advertised and five firms each had participated, whereafter two firms were finally selected and awarded the contract. 4. From the material placed on record, it transpires that neither the contract is under challenge nor the person in whose favour fresh contract has been awarded, is impleaded as a party respondent. In such circumstances, we are not inclined to entertain the present writ petition or to issue any direction for holding of inquiry, as is prayed in the writ. 5. Faced with the objection with regard to maintainability of the present writ petition on the ground that the award of fresh contract itself is not under challenge and, therefore, no direction for holding of inquiry is warranted, learned counsel for the petitioner comes up with a prayer to withdraw this petition with liberty to file a fresh petition with better particulars and details. 6.
