JUSTICE ARUN DEV CHOUDHURY ORDER 07.02.2025 1. Heard Mr. U.S. Bora, learned counsel for the petitioner and Mr. R. Borpujari, learned Standing counsel, Revenue Department, Assam for the respondent. 2. The present application is filed alleging violation of the Court’s order dated 25.09.2024 passed in WP(C) No. 1505/2024. The operative portion of the aforesaid order is quoted herein below:- “In view of the above, this writ petition stands disposed of by providing that the respondents shall take a decision in the matter at the earliest and notify the same. Page No.# 2/2 It will be open for the respondents either to pursue the present selection if the same is permissible as per the Rules or to go for a fresh selection process, if so advised. Writ petition stands disposed of.” 3. Mr. Borpujari, learned Standing counsel, Revenue Department, Assam obtained a status report in respect of the decision of the respondent authorities and also produced copies of the communication addressed to him in this regard by the District Commissioner, Nalbari. 4. From the communication what is discernible is that after the aforesaid order dated 25.09.2024, the matter was assessed thoroughly and the decision was taken to seek instruction from the Government for a fresh recruitment process. Accordingly, by the communication under No. NPE-04/2024/HC/88 dated 27.11.2024, the matter was communicated to the Director of Land Records & Survey for his instruction. Thereafter, the matter is pending before the Principal Secretary to the Government of Assam, Revenue and Disaster Management Department. 5. In view of the aforesaid decision with a proposal to go for a fresh selection process, nothing survives to be adjudicated in this petition at this stage. Accordingly, this contempt petition stands closed. 6. Copies of the communication dated 07.02.2025 along with the annexures appended thereto be furnished to the learned counsel for the petitioner and also be kept on record. 7. Needless to say that in the event, if any cause of action survives, the petitioner shall be at liberty to file an appropriate application including a contempt petition for redressal of his grievances.
