This writ petition has been filed with the following prayer: "(a) Issue a writ, order or direction in the nature of MANDAMUS directing and commanding the respondent no. I to decide the preliminary objections dated 18.10.2024 & 18.03.2025 (Annexure No. 13 to the present writ petition) raised by the petitioner in Appeal No. 2808 of 2024, Computerized Case No. C202414000002808 (Sanjeev Kumar Agrawal and others Vs. Umashankar and others) U/s 207 of U.P. Revenue Code, 2006 and decide the appeal within stipulated time as fixed by this Hon'ble Court." It is contended by learned counsel for the petitioner that Appeal No.2808 of 2024 (Computerized No.C202414000002808) filed under section 207 of U.P. Revenue Code 2006 is pending consideration before respondent no.1. The sole prayer made in the writ petition is to expeditiously decide the said appeal. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.1-Additional Commissioner (Administration), Varanasi Division, Varanasi to decide Appeal No.2808 of 2024 (Computerized No.C202414000002808) filed under section 207 of U.P. Revenue Code 2006, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
