GP FOR FINANCE PLANNING (AP) The Court made the following order: The above writ petition is filed to declare the action of the respondents in not releasing the amount of Rs.2,92,26,519/- to the petitioner payable to the petition concerning the execution of work i.e. “Urgent repairs to the road (a) from KM 0/0 to KM 11/4 of Gollapalli to Ganapathipalli (via) Seegupalli road in Anantapuramu District, (b) from KM 0/0 to 17/534 of Pargi to Serikolam (via) Paidety in Anatapuramu District”, as illegal and arbitrary. 2. A counter affidavit was filed on behalf of respondent No.3 wherein it was stated as follows:
“Further, it is to submit that as per Agreement condition, the rate of progress of work for the 1st Mile stone is Rs.2,68,28,455/- (approximately 100% of the work). On request of the contractor, necessary Extension of time has been sanctioned for the above work upto 31-10-2023. Accordingly the contractor started the work and executed the work worth of Rs.2,67,10,244/- (excluding L.S. amounts) as on 28-10-2023. Based on the work done by the contractor, necessary bill is prepared for Rs.2,92,26,519/-. But the above bill is not uploaded for want of necessary Budget release order for Gross amount Rs.2,92,26,519/-.”
3. Heard Sri L. Sai Manoj Reddy, learned counsel for the petitioner; Sri Ch. Praveen, learned Assistant Government Pleader for Roads and Buildings, for respondents 1, 3 and 4 and Smt. Chandrika, learned Assistant Government Pleader for Finance, for respondent No.2. 4. Learned counsel for the petitioner submits that despite completion of the work as per the agreement No.91/2021-22 dated 05.10.2021, the respondents have not released the amount. 5. Learned Assistant Government Pleader for Roads and Buildings, while not disputing the petitioner’s entitlement, submits that the bill is not uploaded for want of the budget release order. 6.
Given the averments in the counter affidavit, since there is no dispute regarding the petitioner’s entitlement, this writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, directing the respondents to release the amount of Rs.2,92,26,519/- to the petitioner

W.P.No.3514 of 2024 concerning the execution of the aforementioned work, within four months from the receipt of a copy of the order. No order as to costs.
