THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT IN THE NHATURE OF MANDAMUS OR DIRECTION DIRECTING THE RESPONDENT NO.3 TO CONSIDER THE REPRESENTATIONS OF THE PETITIONER DATED 26.12.2018 AND 07.03.2019 VIDE ANNEXURES-B AND C AND PAY THE INTEREST ON DELAYED PAYMENT OF PENSIONARY BENEFITS DCRG (DEATH CUM RETIREMENT GRATUITY) & COMMUTATION. ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer: a. Issue a writ in the nature of Mandamus or direction directing the Respondent No.3 to consider the representations of the petitioner dated 26.12.2018 and 07.03.2019 vide ANNEXURES-B and C and pay the interest on delayed payment of Pensionary benefits DCRG (Death Cum Retirement Gratuity) & commutation, to meet the ends of justice. b. Issue any other orders or order, directions or direction as this Hon’ble court deems fit in the circumstances of this case in the interest of justice. 2. The petitioner is an employee of the respondent University and retires on attaining the age of superannuation on

30.09.2015. The claim of the petitioner is that the terminal benefits i.e. DCRG and commutation is not released to the petitioner.
Therefore, he had to approach this Court in Writ Petition No.100252 of 2018, wherein a direction was issued to consider the representation. Till today, no steps are taken to release the terminal benefits of the petitioner. Therefore, the present petition. 3. In the light of the said circumstance, I deem it appropriate to direct the respondent University to pass necessary orders on the representations submitted by the petitioner vide Annexures-B and C with an outer limit of 12 weeks from the date of receipt of a copy of the order in the event, no orders are passed as on today. In the event of orders being passed, it is open to the petitioner to avail of such remedy as available in law. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE
