The petitioner has been made accused in connection with Garhwa P.S. Case No. 427 of 2024, corresponding to G.R. No.958 of 2024 for the offences registered under sections 331(4) and 305 of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Garhwa. On 06.08.2024, theft was committed in the house of the Informant. Unknown thieves took away several articles including jewellery and of Rs. 75,000/- cash. It was submitted that nothing incriminating has been recovered from the possession of the petitioner. It was further submitted that similarly situated co-accused person has been granted bail by this Court vide B.A. No.10901 of 2024. Learned Spl.P.P. has opposed the prayer for bail. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S.
