No.65 of 2025 O R D E R This Writ Petition (Criminal) has been filed by the petitioner to quash the impugned order passed by the respondent in Na.Ka.No.31/2025/Va.Ka.Ni/ dated 10.06.2025 and consequently direct the respondent to grant permission and police protection to conduct cultural programme (Adal Padal Nigalchi) in the event of Karuvakurichi Village Sree Varadharaja Perumal Temple Festival at Mannarkudi Taluk, Thiruvarur District on 14.06.2025 between 06.00 p.m. and 11.00 p.m. 2. The learned counsel for the petitioner submitted that the petitioner, on behalf of his village, made a representation dated 10.06.2025 before the respondent police seeking permission and protection to conduct cultural programme in the event of Karuvakurichi Village Sree Varadharaja Perumal Temple Festival at Mannarkudi Taluk, Thiruvarur District, but the same was rejected by the respondent police vide impugned proceedings dated 10.06.2025. Therefore, the present petition is filed for the relief stated above. 3. Heard both sides and perused the materials available on record. Page 2 of 6 https://www.mhc.tn.gov.in/judis W.P.(Crl.) No.65 of 2025 4. The reasons stated in the impugned order are un-reasonable. Therefore, the impugned order dated 10.06.2025 passed by the respondent police is quashed. 5. The respondent police is directed to grant permission with reasonable conditions and provide police protection for the cultural programme (Aadal padal nigalchi) to be conducted on 14.06.2025 during night time from 6.00 P.M. to 11.00 P.M. on the eve of "Karuvakurichi Village Sree Varadharaja Perumal Temple Festival at Mannarkudi Taluk, Thiruvarur District" subject to the following conditions: (a) the Aadal padal programme scheduled to be held on 14.06.2025 should be completed before 11.00 midnight or within the time permitted by the respondent police. (b) There should not be any kind of obscene dance or vulgar dialogues during the performance, by anyone of the participants. (c) Double meaning songs should not be played so as to spoil the minds of students and youths. Page 3 of 6 https://www.mhc.tn.gov.in/judis W.P.(Crl.) No.65 of 2025 (d) No dance or songs, touching upon any political party or religion or community or caste shall be played. (e) No flex boards in support of any political party or communal leader, shall be erected at the premises of the programme. (f) The function shall not affect either religious or communal harmony and shall be conducted without any discrimination based on caste. (g) If there is violation of any one of the conditions imposed, the concerned police officer is at liberty to take necessary action, as per law and stop such performance forthwith; and (h) Similarly, the police is directed to stop the dance programme, if it is played beyond the permitted time limit. It is open to respondent police to put any further restrictions or to impose any conditions purely in the interest of preserving public order and tranquility. 7. This Writ Petition (Criminal) is disposed of with the above observations and directions.
