PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Crime No.41 of 2024 of Munchingiput Police Station, Alluri Sitharama Raju district. 2 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that, on 26.10.2024, on credible information, the Sub-Inspector of Police, Munchingiput Police Station, along with his staff and mediators, while conducting vehicle checking at Labburu village junction, Jolaput Panchayat, Munchingiput Mandal, found four persons in possession and illegal transportation of 100 Kgs of Ganja in Auto bearing registration No.OD 30F 1059 and motor bike bearing registration No.OD 18 K 0139. The driver of the Auto escaped from the scene and the police arrested remaining three persons and seized the contraband along with vehicles and other material under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 100 Kgs of Ganja, which is a commercial quantity. It is 3 submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and other accused are to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3 at this stage. 6.
