In Re : Abu Bakkar Mallik @ Asraful ... Petitioner.
Mr. Arindam Jana Mr. Yuvraj Chatterjee
... for the petitioner.
Mr. Madhusudan Sur, Mr. Sujoy Sarkar
... for the State.
Status report submitted by the State is taken on record. It appears that out of 34 charge sheeted witnesses 7 witnesses have been examined and the prosecution proposes to examine 23 more witnesses. Learned counsel for the State submits that there are at least 3 criminal cases registered against the petitioner earlier. Learned counsel further submits that examination of the witnesses may be concluded within a year from date. Prayer for bail of the petitioner was turned down by this Court by an order passed on 17th October, 2023 in CRM (DB) 4068 of 2023 upon consideration of the merits of the case. On the same consideration, the prayer for bail is rejected at this stage.
2 However, if examination of witnesses is not complete within a year from date, the petitioner shall be at liberty to renew his prayer. It is expected that both the parties shall co operate in expeditious disposal of the case. The application for bail, being CRM (DB) 349 of 2025, is thus disposed of. Case Diary be returned. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
