Neutral Citation No. - 2025:AHC:100765 Court No. - 4 Case :- WRIT - A No. - 8242 of 2025 Petitioner :- Krishna Kant Pandey Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Sadhana Dubey,Shashi Kant Shukla Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Sri Shashi Kant Shukla, learned counsel for the petitioner and Sri Manoj Kumar Singh, leraned counsel for all the respondents.
2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has questioned the order of transfer dated 20.05.2025 on the ground that the office memorandum provides for adjustment of the employee (husband) as far as possible at the station where the wife is posted, even if one is in the State Government service and other is Central Government Servant. According to him since his wife is currently posted as Lekhpal at district Chanduali, as per office memorandum, the petitioner is also liable to be posted either at Chandauli or at a near by place to Chandauli.
3. Learned counsel for the respondents contends that the petitioner had earlier made a representation in which he did not raise this ground and has only raised medical issue which has been considered and the representation has been rejected.
4. Be that as it may, since the petitioner has already joined at the place of transfer, I consider it appropriate that the petitioner makes a representation before the competent respondent authority within a period of two weeks from today and if does so, the authority shall take final decision in the matter within a further period of four weeks in the light of provisions as contained in the office memorandum.
5. Needless to add that the order to be passed shall be reasoned and speaking one.
6. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 1.7.2025/Deepika Digitally signed by :- DEEPIKA SINGH High Court of Judicature at Allahabad
