Sri. Shadab H.Yadawad., learned counsel for the petitioner is present and has filed a memo seeking withdrawal of the petition. The contents of withdrawal memo read as under:
“Herein the memo for withdrawal is submitted on behalf of the petitioner is as under.
The petitioner inadvertently has filed criminal petition instead of filing criminal appeal challenging the impugned order. Therefore the petitioner may kindly be permitted to withdraw the present petition with a liberty to filed criminal appeal challenging the impugned order.”

Learned counsel for the petitioner submits that due to oversight, this petition has been filed under Section 438 of Cr.P.C instead of filing criminal appeal under

Section 14A (2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and hence, it may be converted from criminal petition to criminal appeal.
