Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed challenging the order dated 07.04.2025 by which an application under Section 5 of Limitation Act filed to condone the delay in filing a miscellaneous appeal has been allowed. 3. From the perusal of record, it is apparent that finding of facts has been recorded by the court below that notices issues in the misc. appeal was served upon the petitioner who was the plaintiff before the court below. 4. Since, notices have been served and no objection has been filed by the petitioner, no illegality has been committed by the court below in condoning the delay in filing the misc. appeal. 5. The petition lacks merit and is accordingly, dismissed. 6. This order has been passed in presence of Shri Sanjeet Kumar Dubey, Advocate holding brief of Shri A. K.
