Pradeep … for the petitioner Mr. Rakesh Kumar … for the respondents November 04, 2025 [SR] Item No. 4 The writ petition is disposed of, permitting the petitioner to operate the container and sell foods exclusively from the container. There will be no gathering in front of the container except for the purpose of take away. The customers may consume the food purchased by them, but there cannot be any sitting arrangement. All temporary constructions , chairs, tables which the petitioner had placed in the space on the footpath and the walkway shall be removed with immediate effect. The municipal council is entitled to remove the same. However, the municipal council is directed to renew the licence as per law, granting the petitioner the licence to operate exclusively from the container and if any violation is observed, the municipal council will take steps in accordance with law. The terms and conditions of licence and renewal thereof will be subject to the compliance of all necessary formalities. The petitioner undertakes before the Court through the learned advocate that, the unauthorized constructions, chairs, 2 tables, utencils etc, shall be removed from the walkway immediately. The writ petition is disposed of accordingly. As no affidavit-in-opposition has been called for, the allegations made by the petitioner are deemed to be denied.
