4. Further, upon filing fresh petition, report was called for and it is important to record the last Trial Court report dated 11.07.2025 according to which the Investigating Officer, Sarvajeet Kumar has already been examined but a petition was preferred by the defence side for issuance of summon for his re- examination. However, the said petition dated 27.06.2025 has not been pressed and as such, no order could be passed. The further undertaking has been given that within few months, if the learned counsels cooperate, the same shall be taken to its logical conclusion.
5. Considering the allegation that has come coupled with the fact that the defence side is delaying the trial, for the present, this Court is not inclined to extend him the privilege of bail.
6. Accordingly, the bail application stands rejected.
7. Learned Trial Court is directed to abide by the undertaking given and see to it that the trial is concluded and an
order is passed within the time undertaken.
