APHC010062782025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3331] FRIDAY ,THE FOURTEENTH DAY OF FEBRUARY TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE SUBBA REDDY SATTI WRIT PETITION NO: 3738/2025 Between: Smt.g.giddamma ...PETITIONER AND The District Collector And Magistrate and Others ...RESPONDENT(S) Counsel for the Petitioner: 1. C SRINIVASA BABA Counsel for the Respondent(S): 1. GP FOR SERVICES III 2. GP FOR SERVICES I The Court made the following ORDER: Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services-I for the respondents. 2. The petitioner, mother of late Raghavendra Yadav, who died in harness while working as Record Assistant in the Government Girls High School, Kurnool, filed the above writ petition to declare the action of respondent 2 authorities in not considering her grand-son to appoint him on compassionate grounds, as illegal and arbitrary. 3. In the affidavit, it is pleaded that the petitioner’s 2nd son late Raghavendra Yadav died on 04.06.2023. The petitioner seems made a representation on 17.11.2024 to consider her grandson (son of her elder son) for appointment on compassionate grounds. Since her representation is not considered, she filed the above writ petition. 4. Learned Assistant Government Pleader for Services-I, on the other hand, would submit that the son of late Raghavendra Yadav did neither make any application nor approached this Court seeking appointment on compassionate grounds. The mother of the deceased has no locus to file the writ petition and prayed to dismiss the writ petition. 5. Thus, as seen from Ex.P.1 representation dated 07.11.2024 made by the petitioner, the deceased is the son of the petitioner. The deceased first marriage was dissolved and thereafter he was in a live-in relationship with one Smt.K.Venkateswari. The name of Smt.K.Venkateswari is recorded in the service register of the deceased. After the death of Raghavendra Yadav, the petitioner’s grandson (son of elder son) is looking after the welfare of the petitioner. She also filed O.S.No.222 of 2023 on the file of the II Additional Junior Civil Judge, Adoni. The events, referred to supra, would indicate that the petitioner is requesting the authority to employ on compassionate grounds the deceased brother’s son. 6. As rightly pointed out by the learned Assistant Government Pleader for Services, the representation made by the petitioner, reflects the filing of the suit by the petitioner and also disputes. The request made by the petitioner to employ her grand-son, (son of her elder son), on compassionate grounds 3 prima facie, is impermissible. There are no merits in the writ petition and the writ petition is liable to be dismissed. 8. Accordingly, the writ petition is dismissed. No order as to costs. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI Date: 17.02.2025 KA 4 114 THE HONOURABLE SRI JUSTICE SUBBA REDDY SATTI WRIT PETITION NO: 3738/2025 Date: 17.02.2025 KA
