THIS PETITION COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE PRADEEP SINGH YERUR) This petition is filed seeking quashing of the suspension order dated 18.06.2025 bearing No.KA.KA. RA.SAA/KOVI/SHISHA/523/2025/2001/2025 and put back the petitioner into service in the post and place held by him earlier. This Court granted an interim order of stay of the suspension order vide order dated 07.07.2025. 2. The learned counsel for the respondent/Corporation has filed a memo dated 23.07.2025, which reads as under : “In the above petition, the petitioner challenged the order dated 18.06.2025 vide Annexure-G and this Hon’ble Court by an order dated 07.07.2025 granted the interim order. The respondent Corporation undertakes to revoke the - 3 - HC-KAR NC: 2025:KHC-D:9165 WP No. 104293 of 2025 suspension order as per the circular on the ground that 30 days completed. Wherefore, the respondents pray that, this Hon’ble Court may be pleased to dispose of the above matter by revoking the suspension order dated 18.06.2025 vide Annexure-G by giving liberty to the respondent Corporation to continue the disciplinary proceedings against the petitioner and liberty to transfer to some other Depot in the interest of justice and equity.” 3. The first portion of the memo reads that respondent is the Corporation undertakes to revoke the suspension order as per the circular on the ground that the 30 days is completed, same is accepted. Considering the same, the petition would be disposed of. However, respondent/Corporation in the second portion of the same sought for liberty to transfer the petitioner to some other Depot that cannot be granted by this Court it is left to the wisdom of the respondent Corporation to act in accordance with law against the petitioner. - 4 - HC-KAR NC: 2025:KHC-D:9165 WP No. 104293 of 2025 4. In view of the memo and having taken into consideration the revocation of the suspension order of petitioner, I pass the following : ORDER Petition is disposed of on the basis of the memo dated 23.07.2025 filed by the respondent/Corporation as the suspension order of the petitioner dated 18.06.2025 is revoked.
