Counsel for Applicant :- Dheeraj Kumar Dwivedi,Mirza Faheem Beg,Rajesh Dwivedi,Rakesh Dubey Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard Sri Rakesh Dubey, learned counsel for the applicant; learned AGA for State and perused the material on record. The instant bail application has been filed on behalf of the applicant, Salamat Ali, with a prayer to release him on bail in Case Crime No.97 of 2024, under Sections 366, 376, 506 I.P.C 67 I.T. Act and Section 3/5(1) Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, Police Station Shivli, District Kanpur Dehat. There is allegation in the first information report that the informant was enticed away by the applicant six months ago. He committed forcible rape and made her video and photographs and on the basis of which he committed the offence of rape against her for last six months. On 27.03.2024 he again abducted her and sexually exploited her and made her obscene photographs viral. He is also threatening to kill her husband.
Learned counsel for the applicant submits that no incriminating photographs or video of the victim were made viral by the applicant. The victim herself has sent her photographs and video from her own mobile on the mobile phone of the applicant. The first information report has been lodged because of pressure of her husband against the applicant. In the first information report no date and time of the incident has been mentioned. The victim is married and major woman. She eloped with the applicant and lived with him for last six months as admitted by herself in the first information report. Learned AGA for the State has opposed the submissions and submitted that the Investigating Officer has found that the applicant has made the obscene and objectionable photographs of victim viral on instagram, face book, whatsapp and social media. He has submitted that the victim is married woman and the act of the applicant of making her obscene photographs and videos viral on social media is grave offence which has caused irreparable harm to the victim. In the counter affidavit the relevant parcha in this regard has been brought on record. This Court after hearing the learned counsels for the parties does not finds any
ground for enlarging the applicant on bail at this stage. The bail application is accordingly rejected. The trial court is directed to conclude the trial against the applicant as expeditiously as possible as per section 346 B.N.S.S.
