He submits that in terms of Section 105 CPC, he would challenge the order, which is impugned herein, in the aforesaid appeal and, therefore, does not press the present petition. 3. The present petition is disposed of as not pressed in aforesaid terms. 4. All rights and contentions of the parties are, however, reserved.
