The present bail application has been moved by the applicant-accused Aas Mohammad for the offence punishable under Sections 2/3 of U.P. Gangster Act, in Case Crime No. 100 of 2025, Police Station- Tappal, District-Aligarh. 2. Ms. Shobha Vati learned advocate, appears and submits that there is one case shown in the gang chart to the credit of the accused applicant wherein the accused- applicant is on bail. It is further submitted that there is criminal history of two cases to the credit of the accused-applicant apart from the gang chart, in which he is on bail and duly explained in supplementary affidavit. The accused-applicant is languishing in jail since April, 2025. 3. Per contra, learned A.G.A. opposed the bail application and submits that the accused is having criminal history though he has been bailed out in those cases, but is habitual offender. 4. This court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records. 5. The record prima facie reveals that the accused-applicant is on bail in the base cases and case shown as criminal history. He is in jail since April, 2025. 6. Hence, without touching merit of the case, the bail application is allowed. 7. Let the applicant be released on bail in the aforesaid case crime on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
