1. 1. Heard learned counsel for the respective parties. 2. Instant petition is filed for release of the petitioner on bail in connection with Khallikote P.S. Case No. 1015 of 2024 pending in the file of learned JMFC, Khallikote corresponding to G.R. Case No.2402 of 2024 on the grounds stated. 3. Considered the submissions of learned counsel for both the sides. 4. Perused the F.I.R. as at Annexure-1. From Annexure-1, it is made to understand that 450 liters of I.D. liquor, 800 liters of Pochha kept in mud pots and 3 Kgs. of Urea fertilizer have been seized from the spot in the immediate presence of the petitioner, who is a lady. No other accused persons have been arrested in connection with the case. 5. Mr. Sahoo, learned counsel for the petitioner submits that the petitioner is having no other criminal antecedent. 6. Recorded the submission of Mr. Ray, learned AGA for the State, as according to whom, the petitioner has been arrested on 13th December, 2024 during a drive by the local police. 7. Though there has been seizure of good quantity of I.D. liquor and other articles in the presence of the petitioner as she was found at the spot, the Court is of the view that the petitioner, who claims to have no other antecedent, should be allowed to go on bail subject to suitable conditions and under the impression that substantial part of investigation appears to be over. 8. Accordingly, it is ordered. 9. In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with Khallikote P.S. Case No. 1015 of 2024 corresponding to G.R. Case No.2402 of 2024 subject to her furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with two solvent sureties for the like amount each to the satisfaction of the learned JMFC, Khallikote, with an additional condition that she shall not be involved in any other similar criminal activities, while on bail. The Court further directs that such release of the petitioner shall also be subject to verification of antecedent and absence of any such criminal cases of similar nature to be pending against her. 10. The BLAPL is disposed of. 11. Urgent copy of this order be issued as per the rules and in course of the day.
