The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the orders dated 3.1.2025 and 10.1.2025, whereby recovery warrant and Non-Bailable Warrant have been issued by Additional Principal Judge, Family Court, Shahjahanpur in Maintenance Case No. 124 of 2019, arising out of an application under Section 125(3), Cr.P.C. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. However, learned counsel for the applicant fairly argued that the applicant wants to pay the entire maintenance amount in installments. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
