The petitioners have filed instant petition seeking declaration that order dated 09.08.2024 (Annexure P-3) passed by respondent No.1 is ultra virus. They are further seeking direction to reserve the post of Sarpanch for SC category candidate. 2. The instant petition relates to post of Sarpanch of Gram Panchayat, Village Kata Kheri, District Fatehabad. The said seat was reserved for backward class ‘A’. Twice election process was initiated, however, no nomination was filed because no candidate from BCA category was available. Learned counsel for the petitioners submits that 90% population of the village belong to SC category. The post must be reserved for SC candidate in terms of Section 9(5) of Haryana Panchayati Raj Act, 1994. 4. Learned State counsel on instructions from Mr. Anoop Singh Dahiya, DDPO, Fatehabad submits that nominations have already been filed and all the candidates who have filed nominations belong to SC category. Thus, only SC category candidates would be selected. 5. Faced with this, learned counsel for the petitioners does not press the petition. 6. Dismissed as not pressed.
