JUSTICE S G PANDIT) The State Authorities in Agriculture Department are before this Court in this petition under Articles 226 of the Constitution of India questioning the Order dated 23.04.2024 in Application No.10174 and 10175 of 2023 passed by the Karnataka State Administrative Tribunal, Belagavi (for short ‘Tribunal’) wherein it has passed the following order:- “(i) The applications are allowed. (ii) Respondents are directed to take action as per Section 34 of Disability Act, 2016 regarding promotion under reservation quota and consider representations of the applicants within six months of the date of issue of this order. (iii) A copy of this order be made available to Chief Secretary, Government of Karnataka for taking steps for implementing the judgment of the Hon'ble Supreme Court in the case of State of Kerala and Others Vs. Leesamma Joseph (Supra) within a reasonable time.” 2. Heard Sri G.K.Hiregoudar, learned Principal Government Advocate for petitioners and perused the entire writ petition papers. - 4 - HC-KAR NC: 2025:KHC-D:14019-DB WP No. 103569 of 2025 3. During the course of hearing, we noticed that Government by order dated 17.05.2025 has taken a policy decision to provide reservation to the physically challenged to an extent of 4% in the matter of promotion, even to Group ‘A’ Junior scale and Group B post. In view of the above stated government order dated 17.05.2025, the question raised by the government in the present writ petition would no more survive.
