1. This matter is taken up through hybrid mode.
2. This writ petition has been filed by the petitioners challenging the inaction of the Tahasildar, Oupada (opposite party No.1) for non-registration of demarcation case inspite of submission of application before him for the same.
3. Heard from the learned counsel for the petitioners and learned Addl. Govt. Advocate for the State.
4. As per law, it is the duty of the Tahasildar to initiate a demarcation case on the application for the same by any applicant.
As it is the submission on behalf of the learned counsel for the petitioners that, the Tahasildar, Oupada in district of Balasore is not initiating any demarcation
Page 2 of 2. case inspite of submission of application for the same before him, for which, on the basis of the aforesaid
submissions of the learned counsels of the both the sides, it is felt proper to dispose of the writ petition finally directing the Tahasildar, Oupada (opposite party No.1) to register a demarcation case on the basis of fresh application filed by the petitioners along with the copy of this order.
5. Accordingly, the writ petition is disposed of finally.
6. Registry is directed to transmit the copy of this
order to the Tahasildar, Oupada (opposite party No.1).
7. Urgent certified copy of this order be granted to the petitioners on proper application.
