(ORAL) By way of present petition filed under Section 482 of BNSS, 2023, petitioner seeks anticipatory bail in case FIR as under: FIR No. Dated Sections Police Station 152 08.05.2016 408, 506 of IPC and Section 420, 467, 468, 471 of IPC added later on. City Cantt Ambala, District Ambala. 2. Status report dated 30.06.2025 in the form of an affidavit of Deputy Superintendent of Police, Ambala Cantt, District Ambala, has been filed wherein it is specifically mentioned that in compliance to the order dated 29.05.2025 passed by this Court, the petitioner has appeared before the learned trial Court on 05.06.2025. The same is taken on record. Copy thereof has been supplied to learned counsel for the petitioner. 3. Learned counsel for the petitioner submits that in compliance to the order dated 29.05.2025 passed by this Court, the petitioner has appeared before the learned trial Court and furnished the requisite bail bonds KANIKA 2025.07.03 18:23 I attest to the accuracy and authenticity of this order/judgment CRM-M-30682-2025 2 and as such prayed for confirming the interim bail granted vide order dated 29.05.2025. 4. Learned State counsel intimates the Court that the petitioner has joined investigation and is neither required for further investigation nor for any custodial interrogation. 5. During the course of hearing on 29.05.2025, following order was passed: “ 2. Heard. 3. It is, inter alia, contended by learned counsel for the petitioner that the petitioner, after having been granted concession of bail in case FIR (Annexure P-1), vide order dated 22.11.2018 (Annexure P-2), passed by learned Additional Civil Judicial Magistrate, Ambala, in case CHI/1074/2017 titled as ‘State vs. Jeewanpreet Singh’ had been regularly appearing in the learned Trial Court to face the trial, however, on account of illness, he could not put in appearance on 01.05.2025 leading the learned Trial Court, to cancel his bail and issuing non bailable warrants of arrest vide order dated 01.05.2025 (Annexure P-4) passed by Judicial Magistrate Ist Class, Ambala. He further contends that the next date fixed before the learned Trial Court is 31.05.2025. 4. Learned counsel for the petitioner has also placed on record the copy of the OPD card of the petitioner so as to show that the absence of the petitioner was not intentional and contends that if granted the concession of bail, the petitioner will regularly appear in the Court on each and every date of hearing without fail and face the trial. 5. Notice of motion, returnable for 01.07.2025. 6. On the asking of the Court, Mr. Praveen Bhadu AAG, KANIKA 2025.07.03 18:23 I attest to the accuracy and authenticity of this order/judgment CRM-M-30682-2025 3 Haryana, who is present in Court, accepts notice and does not dispute the factual matrix of the case. He submits that next date fixed before the learned Trial Court is 31.05.2025. 7. Keeping in view the above facts and circumstances, the petitioner is directed to appear before the learned Trial Court/Judge on duty/Duty Magistrate within a period of 07 days from today and in that event, learned Trial Court/Judge on duty/Duty Magistrate will admit the petitioner on interim bail subject to its satisfaction on his furnishing requisite bail/surety bonds. 8. The petitioner shall also furnish a specific undertaking before the learned Trial Court/Judge on duty that, in future, he would be regularly appearing before the concerned Court on each and every date and in case of some exigency, he will seek prior permission of the concerned Court qua his exemption to appear on the date fixed. 9. The Trial Court is directed to communicate the order on the appearance of the petitioner in this Court immediately, through appropriate channel well before the date of hearing. 10. Copy of this order be given to learned counsel for the petitioner under the signatures of the Bench Secretary of this Court.” 6. Keeping in view the fact that the petitioner has already appeared before the learned trial Court and furnished his requisite bail/surety bonds consequent to the order dated 29.05.2025, passed by this Court, the present petition is allowed and the interim bail granted vide order dated 29.05.2025 is hereby confirmed. 7.
