JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 06-08-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Town P.S. Case No. 1382/2023 dated 30.08.2023 registered for the offence punishable u/s 419, 420, 467, 468, 471 and 120B of the Indian Penal Code and Sections 66B, 66C and 66D of the I.T. Act. 3. As per the prosecution case, police got information that five cyber criminals were involved in defrauding people in the back side field of circuit house. When the informant with other police personnel went there, five miscreants were present on the car and on seeing police, four miscreants escaped from there and one person was apprehended. On search, three mobile Patna High Court CR. MISC. No.54379 of 2025(2) dt.06-08-2025 2/3 phones, seven airtel SIM cards, six jio SIM cards, nine ATM cards of Axis Bank of different persons, two ATM cards of PNB, three ATM cards of Indian Bank, three ATM card of different banks, one ATM card of co-accused, Alok Ranjan and several passbooks were recovered. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The apprehended person disclosed the name of the petitioner. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 18.06.2025 passed in Cr. Misc. No. 37383/2025. The petitioner has two antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 06.05.2025. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Nawada Town P.S. Case Patna High Court CR. MISC. No.54379 of 2025(2) dt.06-08-2025 3/3 No. 1382/2023, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in the future, the prosecution will be at liberty to move for cancellation of his bail bonds. 7.
