Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "I. set aside the impugned order dated 10.4.2024 passed by pending before Civil Judge (Junior Division) Khalilabad, District Basti in Execution Case No. 8/17 (Ram Murti Vs. Ram Paltan). II. to stay the further proceeding of Execution Case No.8/17 (Ram Murti Vs. Ram Paltan) pending before Civil Judge (Junior Division) Khalilabad, Basti in pursuance of order dated 10.4.2024 passed by Civil Judge (Junior Division), Khalilabad, District Basti." 3. The order impugned has been passed in an execution proceedings. It has been submitted by learned counsel for the petitioner that against the judgment and decree passed, petitioner has filed an appeal being Civil Appeal No.15/2018 (Ram Paltan vs. Ram Murti), which is pending in the Court of District Judge, Basti. He further prayed that a direction be issued for decision of appeal. 4. In view of the above, this writ petition stands disposed of with a direction to the District Judge, Basti to decide the above-mentioned appeal, in accordance with law, expeditiously, preferably within six months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
