Heard learned counsel for the applicant. 2. None has appeared for respondent no.2/accused even in the revised call. 3. Present application has been moved by the applicant seeking cancellation of bail granted to respondent no.2/accused vide order dated 21.11.2023 passed in Criminal Misc. Bail Application No.47722 of 2023 in connection with Case Crime No.109 of 2022, under Section 452, 323, 307, 506 IPC, P.S. Rajpura, District Sambhal. 4. Learned counsel for the applicant states that the accused was enlarged on bail vide order dated 21.11.2023 on the conditions as prescribed in Para 6 of the order. It is stated that despite the conditions imposed in the bail order, the accused committed two offences against the victim for which separate FIRs have been lodged being FIR No.191 of 2024 under Section 504 & 506 IPC, P.S. Gunnaur, District Sambhal lodged against the same accused and FIR No.109 of 2025, under Section 131, 115(2), 352, 351(3) of BNS, P.S. Rajpura, District Sambhal in which the victim was once again attacked by gunshot injury by the family members of the accused who was enlarged on bail. 5. It is stated that both the said offences were committed after the accused being enlarged on bail. 6. Considering the fact that the accused has violated the conditions of the bail and the counsel for respondent no.2/accused is not even present to oppose the bail cancellation application, a clear case for cancellation of bail is made out. Hence, the present application is allowed. 7. Bail granted to respondent no.2/accused namely Rajnesh vide order dated 21.11.2023 passed in Criminal Misc. Bail Application No.47722 of 2023 is cancelled. 8. Respondent No.2/accused is directed to surrender before the trial Court within a period of 15 days from today failing which the trial Court is free to secure his presence in accordance with law.
