1. By virtue of the present petition under Section 482 BNSS, petitioner, who co-accused in case bearing FIR No.64 dated 15.05.2025 registered under Sections 123/305/238 of BNS, 2023 at Police Station Jakhal, District Fatehabad, has prayed for grant of pre-arrest bail.
2. On 28.05.2025, following order was passed by this Court:-
“Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.64 dated 15.05.2025 under Sections 123, 305, 238 of BNS, 2023, registered at Police Station Jakhal, District Fatehabad.
Learned counsel for the petitioner submits that a perusal of the FIR which has been reproduced in the body of the petition reveals that the petitioner has not been named therein; there are specific and direct allegations levelled against co-accused Rupinder Kaur and Lovepreet Singh, however, no suspicion has been raised qua the involvement of the petitioner in the occurrence in question. Learned counsel has submitted that the petitioner has been falsely nominated as an accused in the present PARVEEN KUMAR 2025.09.25 18:54 I attest to the accuracy and integrity of this document
CRM-M-30400-2025 -2- case on the basis of a disclosure statement allegedly suffered by co-accused Rupinder Kaur and Lovepreet Singh; the evidentiary value of the disclosure statement on the basis of which the petitioner has been nominated as an accused is of a weak nature. On a pointed query as to whether the petitioner has any criminal antecedents, learned counsel has categorically replied in the negative. Notice of motion. On asking of the Court, Mr. Rahul Mohan, Sr. DAG, Haryana, accepts notice on behalf of the respondent-State and seeks time to get necessary instructions. Adjourned to 09.09.2025. Meanwhile, the petitioner is directed to join the investigation and appear before the investigating agency as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) of the BNSS.”
3. Pursuant thereto, the status report dated 13.09.2025 in the shape of affidavit of Mr. Umed Singh, HPS, Deputy Superintendent of Police, Tohana, District Fatehabad, has been placed on record. In para 9 thereof, it has been specifically mentioned that petitioner has joined the investigation.

Learned counsel for the petitioner also submits that a co-accused Lovepreet Singh alias Labbu and Rupinder Kaur (daughter-in-law of the complainant) have since been granted concession of the bail.

Keeping in view the above submissions made by learned State counsel and the fact that the petitioner had joined the investigation, interim bail granted vide order dated 28.05.2025 is hereby confirmed, subject to conditions PARVEEN KUMAR 2025.09.25 18:54 I attest to the accuracy and integrity of this document
CRM-M-30400-2025 -3- as envisaged under Section 482(2) BNSS. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will not tamper with the evidence nor will influence the witnesses and will not leave the country without prior permission of the Court.
7. The petition stands allowed.
