The petitioner has been made accused in connection with Manatu P.S. Case No. 40 of 2024 corresponding to POCSO Case No. 116 of 2024, for the offences registered under Section 64(1) of the B.N.S., 2023 and Section 4 & 8 of the POCSO Act, pending in the Court of learned Exclusive Special Judge (POCSO) Palamau, Daltonganj. 3. The petitioner is alleged to have established consensual physical relationship with the victim who is 16 years old girl. 4. Learned counsel appearing on behalf of the petitioner has submitted that the parties were having love affairs and they are on the verge of adulthood. 5. Considering the tender age of the victim, her consent for physical relationship is immaterial. Accordingly, I am not inclined to release the petitioner, on bail.
