The present review petition has been filed by the petitioner / husband for review of the order dated 03.01.2023 passed by Division Bench of this Court in FAM No. 54 of 2019 whereby monthly maintenance of Rs.20,000/- was granted in favour of respondent /wife, which shall be paid by the petitioner / husband. 2 2. Learned counsel appearing for both the parties would submit that, in pursuance of order dated 26.07.2024 passed by this Court, settlement in respect of dispute between the parties alongwith maintenance amount, has been arrived at between the parties in Mediation Center of High Court of chhattisgarh on 23.09.2024 and as per terms of that settlement, petitioner/husband shall give a total sum of Rs.10,50,000/- to the respondent/wife as one time settlement. Therefore, learned counsel for both the parties submit that order dated 03.01.2023 granting maintenance by this Court in paragraph 14 of FAM No. 54 of 2019 may be merged in that settlement and accordingly order dated 03.01.2023 may be modified. 3. We have perused the record as well as settlement arrived at between the parties on 23.09.2024 in the Medication Center of High Court of Chhattisgarh. 4. Vide order 03.01.2023 passed by this Court in FAM No. 54 of 2019, while granting decree of divorce in favour of husband, amount of Rs. 20,000/- monthly maintenance was granted to the respondent/wife. Perusal of the settlement arrived at between the parties shows, that in respect of maintenance, both the parties have settled this count for one time settlement of Rs.10,50,000/- to be paid by the petitioner/husband to the respondent / wife. It has further been settled between them that first installment shall be paid within three months and second installment shall be paid within six months from the date of settlement. 5. Counsel for the respondent / wife submits that first installment of Rs.5,00,000/- has been received through demand draft No. 071126 dated 16.12.2024. 3 6. Having considered one time settlement that has been arrived at between the parties with regard to maintenance amount to be paid by the petitioner / husband to the respondent / wife, we are satisfied with the settlement and accord the same. 7. Accordingly, observation made by this Court in order dated 03.01.2023 passed by this Court in FAM No. 54 of 2019 in paragraph 14 so far as with regard to the payment of maintenance of Rs.20,000/- per month to be paid by the petitioner / husband to the respondent / wife, the same is modified accordingly and it be read as per terms of settlement dated 23.09.2024 whereby it has been agreed between the parties that Rs. 10,50,000/- shall be paid by the petitioner/husband to the respondent / wife as one time settlement. 8. Settlement dated 23.09.2024 be read as part of order dated 03.01.2023 passed by this Court in FAM No. 54 /2019, so far as it relates to the amount of maintenance and copy of aforesaid settlement be attached with order dated 03.01.2023 passed in FAM No. 54 / 2019. 9. Accordingly, this review petition is allowed to the extent sketched hereinabove.
