THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S.R. KRISHNA KUMAR) In this petition, petitioner seeks the following reliefs. 1. Call for the relevant records. 2. Issue a Writ, Order or Direction in the nature of Certiorari quashing the resolution passed by the Selection Committee headed by 2nd respondent dated 09.10.2023 as per Annexue-K insofar as Anganwadi Center 198 of Kundgol is concern, as illegal and void in the interest of justice and equity. 3. Pass such any other order/orders as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice. 4. A perusal of the material on records will indicate that on 24.08.2012, the 4th respondent issued a notification calling for the applications to the post of Anganawadi Worker, to which the petitioner applied and her name was shown in the provisional - 3 - HC-KAR NC: 2025:KHC-D:11954 WP No. 113107 of 2014 selection list dated 01.10.2012. However, subsequently, vide endorsement dated 11.02.2013, the 4th respondent cancelled the selection of the petitioner on the ground that, the petitioner was not residing within the limits of the Anganawadi Center and the residential certificates submitted by her cannot be accepted. The petitioner assailed the said endorsement dated 11.02.2013 in W.P.No.77053/2013, which was disposed of by this Court vide final order dated 28.06.2013 remitting the matter back to the 3rd respondent for reconsideration afresh in accordance with law. 5. By the impugned resolution dated 09.10.2013 at Annexure-K, the Selection Committee headed by the 2nd respondent were rejected the application filed by the petitioner, who is before this Court by way of the present petition. 6. A perusal of the impugned resolution at Annexure-K dated 09.10.2013, will clearly indicate that the valid and cogent reasons have been assigned by the Selection Committee headed by the 2nd respondent for rejecting the claim of the petitioner. I do not find any illegality or infirmity in the impugned resolution at Annexure-K, dated 09.10.2013 nor can be said to be - 4 - HC-KAR NC: 2025:KHC-D:11954 WP No. 113107 of 2014 capricious or perverse warranting interference by this Court in the present petition.
