p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.13267 of 2025 Lachhaman Singh @ Beda … Petitioner Mr. A. Tripathy, Advocate -versus- State of Orissa … Opposite Party Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL)23.06.2026 04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Subalaya PS Case No.135 of 2021 corresponding to SC Case No.14/29 of 2023 pending in the file of learned Addl. Sessions Judge, Sonepur for commission of offences punishable U/Ss.302 of IPC on the main allegation of committing murder of the deceased Sunita Singh by subjecting her to torture and cruelty for demand of dowry, along with co-accused persons in furtherance of their common intention. 3. Heard Mr. Amitav Tripathy, learned counsel for the petitioner and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record together with the copy of deposition of PWs.1 to 10 as produced. 4. The eye witnesses PWs.1, 2 & 10 have not supported the prosecution allegation against the petitioner, but the petitioner is in custody since 30.12.2021 and in the meantime, four years and six months have elapsed, however, the report submitted by the learned trial Court reveals that the prosecution has already examined 11 p. 2 witnesses out of the 53 charge-sheeted witnesses, but the prosecution still intends to examine 17 more charge-sheeted witnesses and, therefore, the trial is not likely to be concluded in near future. In view of the above facts and taking into account the long custody of the petitioner together with grant of bail to co-accused persons earlier, this Court without expressing any view on merit admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:- (i) the petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless their attendance is dispensed with. In case the Petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy) Judge Jayakrushna
