Nath, learned counsel appearing for the petitioner. Also heard Mr. D.C Saha, learned counsel, appearing for the respondent-State. [2] This petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “i. Issue Rule upon the Respondents to show cause as to why a writ in the nature of mandamus and or order/orders, directions, shall not be issued whereby directing the Respondents to grant family pension in favour of the Petitioner upon death of Suhas Ranjan Paul, holder of PPO No. Pen- 2/PPO/SUP/ST/111610367, who died on 01.03.2023. ii. Issue Rule uopn the Respondents to show cause as to why writ in the nature of mandamus and or order/orders directions shall not be issued whereby directing the Respondents Nos. 8 & 9 to forward disburers portion of PPO No. Pen-2/PPO/SUP/ST/111610367 to the senior Accounts officer in terms of the letter, dated, 12.11.2024 issued by the Senior Accounts Officer to the Treasury Officer. iii. Make the rules absolute. iv. Call for records”. [3] It is seen from the record that a communication letter dated 06.12.2024 was made addressed to The Chief Manager, SBI, Agartala Branch, (Pension Cell), West Tripura by the Treasury Officer, Agartala Treasury No. 1 regarding furnishing of original disbursers portion of PPO No. Pen-2/ PPO/SUP/ST/111610367 along with last payment certificate issued in favour of the deceased employee (husband of the petitioner herein) but the same is pending till date. [4] In view of the same, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the concerned respondent i.e. respondent No.8 to consider the communication letter dated 06.12.2024 within a period of 01 (one) month from today in accordance with law. [5] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
