The petitioner is before this Court seeking the following prayer: “A.Issue Writ of Mandamus or any other Order or Direction, directing the Respondents to promote the Petitioner to the post of Deputy Chief Traffic Manager with effect from 08-01-2016 with all consequential benefits by considering the Representations dated 16.01.2016 and 11-12-2023 submitted by the petitioner as per Annexure-A and J2 in terms of the directions issued by this Hon’ble court vide order dated 25.08.2021 passed in W.P No. 105863/2016 as per Annexure-B confirmed by the division bench of this Hon’ble court vide order dated 28.06.2023 passed in W.A.No. 100296/2021 as per Annexure-C. B. Issue Writ of Mandamus or any other Order or Direction, directing the Respondents to promote the Petitioner to the post of Chief Traffic Manager with effect from the date on which he became eligible and further to sanction all the service benefits in favor of - 3 - HC-KAR NC: 2025:KHC-D:16835 WP No. 106182 of 2025 the Petitioner by considering the legal notice dated 11.08.2025 as per Annexure-M. C. Issue any other appropriate Writ or Order or direction which deems fit to grant by this Hon’ble Court under the facts and circumstances of the case in the interest of justice and equity.” 2. The learned counsel appearing for the respondents, Sri. Prashant S. Hosmane, submits that one of the prayers sought by the petitioner, relating to the grant of seniority at the appropriate place, has been considered and the petitioner’s grievance in that regard stands addressed. Insofar as the said prayer is concerned, the learned counsel for the petitioner accepts the same. 3. Insofar as the promotion sought by the petitioner on the strength of the said seniority is concerned, the learned counsel, Sri. Prashanth S. Hosmane, submits that action will be taken in accordance with law. It is stated that the promotion has not been considered only because an interim order is operating in the present case. 4. In light of the said submission, I deem it appropriate to dispose of the petition with a direction to the respondents to consider the case of the petitioner for promotion, on the strength - 4 - HC-KAR NC: 2025:KHC-D:16835 WP No. 106182 of 2025 of the grant of seniority, within an outer limit of 12 weeks, in accordance with law. 5.
