1. In respect of similar cause of action, the petitioner has earlier approached this Court by filing Writ - C No. 25090 of 2024 and it was dismissed by a Co-ordinate Bench by order dated 21.8.2024. 2. The order is extracted below: -
"1. Heard learned counsel appearing for the petitioners and learned Standing Counsel appearing for the State respondents. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the writ petitioners are seeking action on an inquiry carried out by the Joint Director of Education (Secondary), Ist Region, Meerut. This inquiry was carried out in the year
2017. The petitioners have now approached this Court for directions on the respondents to decide the representation made by the petitioners on 16.10.2023. 3. We find that this writ petition has been filed with inordinate delay as the cause of action arose in the year 2017 and the writ petition has been filed in the year 2024. Proper explanation of delay has not been given in the writ petition. 4. In light of the same, the writ petition is dismissed as the same has been filed belatedly with inordinate delay. 5. However, the petitioners are given liberty to approach the appropriate forum for appropriate relief."
3. The petitioner after making a representation, has again approached this Court contending that now it is a fresh cause of action. 4. Concededly, the petitioner has no personal cause of action in the dispute sought to be raised in the writ petition. The cause of action, if any, was in favour of the Society whose property was allegedly occupied by some private persons. The Society has all means to protect its interest. 5. Filing of repeated writ petitions by the petitioner is gross abuse of process of law. 6. At this stage, counsel for the petitioner prays for dismissal of the writ petition as not pressed. 7. Accordingly, the petition is dismissed as not pressed, but with warning to the petitioner not to indulge in any further misadventure, otherwise it will entail heavy cost.
