ORAL ORDER
1. Learned advocate Mr.K.R.Saxena states that he has instructions to appear for and on behalf of respondent No.8 and he has already filed his Vakaltnama.
2. In view of the above submissions, Registry is
directed to delete the name of learned advocate Ms.Dimple Thaker from the array of the parties and show the name of learned advocate Mr.K.R.Saxena for respondent No.8 in the cause title.

3. This application is filed under Section 5 of the Limitation Act,1963 for condonation of delay of 89 days caused in preferring the First Appeal.
4. Heard learned advocate Ms.Kirti Pathak for the applicant. Though served, none appeared for respondent No. 7.
5. Learned advocate for the applicant has submitted that the cause for delay is attributed to the time consumed in decision making process. It is further submitted that the delay is not intentional and there was no lethargy on the part of the applicant.
6. Considering the submissions canvassed by learned advocate for the applicant and averments made in the application, the reason for delay is administrative procedure and time consumed in decision making process. The cause for delay has sufficiently been made out. Hence, the delay is condoned.
7. The application is allowed and stands disposed of. Rule is made absolute.
