Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent. The writ petition has been filed seeking the following relief:- "Issue suitable Writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to 4 to demarcate the land of petitioner and to pay compensation to him for demolished his Pakka House which was built on plot no.310 situated at Village- Parghaipur, Tehsil- Auraiya, District Auraiya." It is not in dispute that the constructions of the petitioner has been demolished. On a query by the Court counsel for the petitioner is not able to state as to the date on which the demolition was carried out. Even otherwise the question of payment of compensation necessarily involves disputed questions of fact which are beyond the scope of writ petition under Article 226 of the Constitution of India, therefore, this Court sees no justification to entertain the writ petition. The writ petition is dismissed leaving it open for the petitioner to sue for compensation in case so advised.
