He has taken several insurance policies, for which he pays Rs.8,22,000/- annually and this fact itself shows his huge financial viability of respondent No.2 who was earlier married to some one else, but he divorced his first wife, when he gained high position and power. The respondent No.2 has admitted that his monthly salary is Rs.2,25,000/-, and even then learned court below has failed to consider the fact that at least 20-30% of monthly income should have been fixed for maintenance. Rita Dey Chowdhury Nee Nandy AIR (2017) SC 2383 placing reliance on a earlier judgment in Dr. Kulbhushan Kumar vs. Raj Kumari and Anr. (1970) 3 SCC 129, in this case, it was held that 25% of the husband's net salary would be just and proper to be awarded as maintenance to the respondent-wife. The amount of permanent alimony awarded to the wife must be befitting the status of the parties and the capacity of the spouse to pay maintenance. Maintenance is always dependant on the factual situation of the case and the court would be justified in moulding the claim for maintenance passed on various factors.
