By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order of cancellation of allotment of official accommodation passed against him on 28.04.2025. It is contended by learned counsel for the petitioner that though the house was constructed but some construction work is still going on and presently the house is not in a condition that anybody can reside therein and in this regard petitioner has made a representation before the competent authority namely the respondent no. 3 on 05.05.2025 which has remained undisposed of till date. Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 3 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 3 shall consider the grievance of the petitioner raised in his representation dated 05.05.2025 and decide the same within a period of six weeks from the date of receipt of certified copy of this order. However, it is provided that till the disposal of said application by the authority concerned, the order dated 28.04.2025 directing for vacation of official accommodation of the petitioner shall not be given effect to, if the petitioner has already not vacated the official accommodation till date.
