Ravinder Kumar Bansal and Ors. Vs. Pankaj Gupta and Ors. CS No. 25 of 2016 07.03.2025 Present: None for the plaintiffs. Ms. Devyani Sharma, Sr. Advocate, with Mr. Anirudh Sharma, Advocate, for the defendants. Plaintiffs No. 2 and 4 have died during the pendency of the suit and no steps have been taken on their behalf for further representation in the suit. Thus, the suit as against plaintiffs No. 2 and 4 already stands abated. None has come forward till date to represent the deceased plaintiffs by seeking setting aside of abatement. Learned counsel for plaintiffs No. 1 and 3 has also withdrawn his power of attorney. In this backdrop, Court notices were issued to plaintiffs No. 1 and 3. It has been reported that the Court notices could not be served upon plaintiffs No. 1 and 3 as they were not found on the addresses mentioned in the memorandum of parties. As result, there is no representation of the plaintiffs and in such circumstances the Court is left with no other option but to dismiss the suit for non-prosecution.
