HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 55973 of 2023 Court No. - 65 HON'BLE SANJAY KUMAR SINGH, J. Heard learned counsel for the applicant, learned Additional Government Advocate representing the State and learned counsel appearing on behalf of the complainant. By means of this third bail application, applicant-Ram Chandra Ram, who is involved in Case Crime No. 187 of 2021, under Sections 342, 376, 452, 506 I.P.C. and Sections 5/6 Protection of Children from Sexual Offences (POCSO) Act, Police Station Jamaniya, District Ghazipur, seeks enlargement on bail during the pendency of trial. First and second bail applications of the applicant were rejected on merits by this Court vide orders dated 14.03.2022 and 28.04.2023 in Criminal Misc. Bail Application Nos. 41206 of 2021 and 49877 of 2022 respectively Main substratum of argument of learned counsel for the applicant is that the applicant is languishing in jail since 23.06.2021, but till date his trial has not been concluded, therefore, considering the detention period of the applicant, he may be enlarged on bail. Per contra, learned Additional Government Advocate for the State as well as learned counsel for the informant opposed the prayer for bail of the applicant by contending that statements of all the prosecution witnesses have been recorded before the trial court. As such trial of Versus Counsel for Applicant(s) : Amit Kumar Yadav, Bheshaj Puri Counsel for Opposite Party(s) : Anand Kumar Pandey, G.A., Ghanshyam Chaubey Ram Chandra Ram .....Applicant(s) State Of U.P. And 3 Others .....Opposite Party(s) the applicant is at the advance stage, hence, bail application of the applicant is liable to be rejected. Having heard learned counsel for the parties and examined the matter in its entirety, I find that it is a case of rape on minor child aged about 12 years. The offence is heinous in nature, hence, considering the gravity of offence and stage of trial as noted above as well as judgment of Hon'ble Supreme Court in the case of X vs. State of Rajasthan and Another, 2024 SCC OnLine SC 3539, I do not find any good ground to release the applicant on bail. Accordingly, the bail application is rejected. However, considering the detention period of the applicant, trial court is directed to make an endeavour to conclude the trial, expeditiously without granting any adjournment to either of the parties. Office is directed to communicate this order to the concerned trial court within two days for necessary information and compliance.
