Akhilesh Kumar Pandey and Another, arising out of Case Crime No.0023 of 2020, under Sections 498A, 323, 504, 342 Indian Penal Code, 1860, and Section 3/4 of the Dowry Prohibition Act, 1961, Police Station- Mahila, District Ghaziabad pending in the court of Civil Judge (Junior Division)/Fast Track Court No.1 (Crime Against Women)/,Judicial Magistrate, Ghazibad to the competent court of jurisdiction at district- Prayagraj. Not only the case was lodged at the instance of the complainant-applicant at Ghaziabad, but even otherwise, the trial is yet to commence as the accused has not appeared so far. The subsequent change of place of residence of the applicant- complainant from Ghaziabad to Bhadohi cannot be considered as a valid ground for transfer of the case. This application is dismissed.
