Challenge in this application under Section 528 BNSS is to charge sheet dated 19.01.2025 submitted in Case No. 2554 of 2025 (State vs. Sainki) arising out of Case Crime No. 0476 of 2024, under section 74, 76, 64(2)(5) and 115(2) of BNS, 2023, Police Station Jhinjhana, District Shamli and also quash all the consequential proceedings of the case mentioned above including summoning order dated 25.03.2025 passed by the learned Civil Judge (J.D.)/ F.T.C., Shamli. 3. After arguing at some length, learned counsel for applicant submits that he wants to withdraw the application and liberty may be given to the applicant to file a bail application before the court of competent jurisdiction. 4. In view of above, the application is disposed of as withdrawn with liberty to the applicant to appear before court concerned and file an appropriate application for bail, which shall be decided in accordance with law on merit.
